Agreement to Terms

These Terms of Service ("Terms") govern your use of the BrainGuard mobile application ("App," "Service," or "BrainGuard") operated by CLSS Studio ("we," "our," or "us"). By downloading, installing, or using BrainGuard, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Description of Service

BrainGuard is a mindful technology management application that helps users:

• Block access to selected apps, app categories, and websites
• Practice guided meditation with breathing exercises and ambient sounds
• Unlock temporary access (15 minutes) to blocked content after completing meditation sessions
• Customize meditation duration (60-600 seconds) and background sounds
• Track meditation completion sessions

System Requirements and Permissions

Device Compatibility

BrainGuard requires iOS devices with Screen Time and Family Controls capabilities. The App integrates with Apple's native frameworks and requires:

• iOS Screen Time authorization for app blocking functionality
• Device Activity monitoring permissions
• Notification permissions for meditation reminders
• Audio playback permissions for meditation sounds

User Responsibilities

You are responsible for properly configuring your device permissions and understanding that BrainGuard's effectiveness depends on maintaining these permissions. Disabling Screen Time access will prevent the App from functioning as intended.

Subscription Terms

Premium Features

BrainGuard offers subscription-based premium features including:

• Ability to select and guard specific apps, categories, and websites
• Full access to meditation unlocking functionality
• All ambient sound options for meditation sessions

Subscription Options

• Monthly Subscription: Full access to app blocking features
• Yearly Subscription: Full access with 3-day free trial

Billing and Payment

All subscriptions are processed through Apple's App Store. Payment will be charged to your Apple ID account upon confirmation of purchase. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period. You can manage and cancel subscriptions through your Apple ID account settings.

Free Trial

Yearly subscriptions include a 3-day free trial. If you cancel during the trial period, you will not be charged. If you do not cancel, your subscription will automatically begin at the end of the trial period.

Refunds

Refund requests are subject to Apple's App Store refund policy. We do not directly process refunds. To request a refund, contact Apple Support or use the "Report a Problem" feature in your Apple ID account.

Acceptable Use

Permitted Use

You may use BrainGuard for personal, non-commercial purposes to:

• Manage your personal device usage and digital wellness
• Practice meditation and mindfulness techniques
• Create healthy technology habits

Prohibited Use

You agree not to:

• Attempt to circumvent or disable the App's blocking functionality
• Reverse engineer, decompile, or disassemble the App
• Use the App for any illegal or unauthorized purpose
• Share your subscription access with others
• Interfere with the App's operation or Apple's Screen Time services

Intellectual Property

BrainGuard, including its original content, features, functionality, design, audio files, and visual elements, is owned by CLSS Studio and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any part of the App without our express written permission.

Privacy and Data

Your privacy is important to us. BrainGuard is designed with privacy-first principles, storing all user data locally on your device. We do not collect, store, or transmit personal information to external servers. For complete details, please review our Privacy Policy.

Disclaimers and Limitations

Service Availability

BrainGuard depends on Apple's Screen Time and Family Controls frameworks. We do not guarantee uninterrupted access to these services and are not responsible for changes to Apple's underlying systems that may affect the App's functionality.

Health and Wellness

While BrainGuard includes meditation features, it is not intended as a substitute for professional medical advice, diagnosis, or treatment. If you have concerns about your mental health or digital wellness, consult with qualified healthcare professionals.

Effectiveness

The effectiveness of BrainGuard in reducing device usage or improving digital wellness may vary by individual. We make no guarantees about specific outcomes or behavioral changes resulting from use of the App.

Limitation of Liability

To the fullest extent permitted by law, CLSS Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of BrainGuard.

Termination

We may terminate or suspend your access to BrainGuard at any time, with or without cause or notice, including if you breach these Terms. You may terminate your use of the App at any time by:

• Deleting the App from your device
• Canceling your subscription through your Apple ID account
• Revoking Screen Time permissions through iOS Settings

Updates and Changes

We reserve the right to modify these Terms at any time. We will notify users of any material changes through the App or by email. Your continued use of BrainGuard after such modifications constitutes acceptance of the updated Terms. We may also update the App's features, functionality, or user interface through App Store updates.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where CLSS Studio operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
